VIP CONSIGNOR AGREEMENT

         No. I understand that if I do not verify my email address before the end of the event, my check will be delayed.

 

     I would like to PICK-UP my unsold items at the end of the event. I understand that my items are not guaranteed since I'm participating in the VIP Consignor Program.

Settlement of Account

As a Consignor I agree to offer quality items priced at approximately 25%-30% of retail price. I understand that I will receive 40% of my total sales. I understand that I will pay a participation fee of $12.50 + 7.50 supply fee for every 300 items entered into the event, which will be deducted from my settlement check.

Waiving Terms of Guarantee

Rhea Lana's of Texarkana does not guarantee items received through the VIP Consignor Program. By signing this agreement, you understand that you're waiving the Guarantee of your consigned items. In addition, a guarantee shall not apply to any loss resulting from a natural disaster, fire, flood, tornado, storm hurricane, or other Acts of God.

If items not belonging to Consignor are accidentally provided to Consignor with Consignor's returned items, Consignor agrees to return these items to Rhea Lana's of Texarkana immediately.

Liability for Recalled Items

Rhea Lana's of Texarkana is aware and supportive of the efforts of the Consumer Protection Safety Commission to remove recalled items from the resale industry. Rhea Lana's of Texarkana has resources containing information on recalled products available for consignor review. Consignor agrees not to consign any unsafe or recalled items. Rhea Lana's or Texarkana, the individual owner of Rhea Lana's od Texarkana, nor Rhea Lana's Franchise Systems, inc. shall not be liable for the sale of unsafe or recalled items which are offered for sale by Consignor. Consignor shall defend and indemnify Rhea Lana's of Texarkana, the individual owner of Rhea Lana's of Texarkana, and Rhea Lana's Franchise Systems, inc. in the event of any claim or liability arising from Consignor's sale of an unsafe or recalled item at Rhea Lana's of Texarkana event.

Donated Items

Rhea Lana's of Texarkanais not a non-profit 501 (c)(3) organization. Consignor shall not receive a donation receipt. Consignor has the choice of picking up their unsold items during the designated pick-up hours or leaving their items behind. If you wish to make a tax-deductible donation DO NOT select the option to donate your unsold items on the Rhea Lana's of Texarkana website. Items marked for donation as well as items not picked up during the designated pick-up time shall become the property of the individual owner of Rhea Lana's of Texarkana and shall be handled at the sole discretion of the owner of Rhea Lana's of Texarkana.

By selecting "Donate" for any item in my online Rhea Lana's of Texarkana account, I acknowledge that these items will not be made available to me during the designated pick-up hours, will not be subject to the Guarantee (described above), and such items will be under the sole control and possession of the owner of Rhea Lana's of Texarkana.
